if thats the case, why not? and where did it come from, whats its yichus to the tzemach tzedek etc.?

why not? because it was seized by the Russian authorities and is now in a State library. People go and either take pictures or copy them word for word. I also assume that it's in a "bichel Chassidus" from the TT and is recognizable through his handwriting.

I am unfamiliar, but surprised that there is still דא"ח floating around that was never published. How much more is out there?

Thank you to the many responses regarding the recent Maamarim. The attribution to the Tzemach Tzedek needs clarification and I apologize for not including the details, in the haste to share these remarkable teachings for Yud and Tu Beshvat. Many manuscripts collections of Maamarim contain Maamarim from the Tzemach Tzedek and his sons. In addition there were others who wrote down the Maamarim in their own words. Both the Maamarim from the Tzemach Tzedek and his sons and the hanachos were copied over by many copyists, Maatikim.
After careful comparison, the Maamar Meoded Anavaim is a Hanacha by the Ranat, Reb Menachm Nachum Tuvia from Firatin. He was one of the main Manichim of the Tzemach Tzedek as seen in the printed Maamarim of the Tzemach Tzedek in Hanachos. The Maatikim were based on his hanacha and many mistakes crept in and only after careful review and thought was the final Maamar sent out.
The Ranat did write his own maamarim as well, not from the Tzemach Tzedek and he is the recipient of some tough criticism, due to his brilliance, which needs to be understood in the proper context, just as stories regarding the Strosheler the Magen Avos, Bichovski etc. The Rebbe BH brought much shalom and achdus in this area and may we continue in his holy ways.
Parts of the Maamar from Korach are found broken up in Ohr Hatorah attributed to the Tzemach Tzedek . The present maamar is beautifully ordered.
There are certainly parts of Ohr hatorah that have additions or even Maamarim from others, based on the Maamarim of the Tzemach Tzedek.
As an educated guess after much thought, I believe that these Maamarim came from Maamarim of the Tezmach Tzedek, but please note: they are not his handwriting or exact words.
In Hafaztas Hamaayanos, the world of Chutzah is sometimes quite dark and difficult. The fact that unseen or unknown Maamarei Chassidus are coming to light is a siman Tov to the words of the Baal Shem Tov.
In the future, I will try to be more careful in my correspondence, as my efforts have simply been to share what I have found in my personal study, not a critical edition for publication.

R' Hirshel - are you saying this is from the Schneerson collection (now housed in Moscow museum, and digitally scanned online) OR the military archive (which was found in the late 90s and much of it has been published - rabash and althoiz diaries, maamorim etc) ?

Akiva makes no mention of its whereabouts, or if possibly from a third unrelated source. Akiva, care to elaborate?
